Medical Malpractice Settlement
Attorney Cramer recently obtained a $250,000 medical malpractice settlement on behalf of our client, a 72 year old woman, who was improperly restrained by emergency room hospital personnel. The lawsuit was the result of an incident that occurred when our client arrived at the emergency room suffering from an altered mental status as a result of a longstanding history of erratic psychological behavior. She became combative and was restrained by staff and security while they attempted to place her in a restraint jacket. The hospital staff restrained her with such force that she sustained a severely broken left shoulder as well as an aggravation of her pre-existing depression and anxiety disorder. Through expert testimony we were able to prove that the conduct of the hospital staff deviated from the standard of care as it relates to the treatment of patients who present with severe psychological symptoms. The use of restraints in such a situation is only to be used as a last resort. The case resolved after 2 days of mediation.
