The accident occurred on the Merritt Parkway in Westport, Connecticut when our client was rear-ended by the defendant’s vehicle. The defense claimed the impact was minor and did not cause any injury to our client and thus denied responsibility for his damages. Our client sustained a herniated disc to his cervical spine which resulted in surgery consisting of a double level anterior cervical discectomy with fusion. In addition to the surgery on his back, our client sustained permanent injury to his neck rendering him unable to participate in his usual recreational activities causing a severe loss of enjoyment of life’s activities. We were able to prove through the plaintiff’s treating physician that the disc herniation and subsequent surgery were a direct result of the motor vehicle accident. The case settled after one day of mediation.
Attorney Cramer recently settled a mild traumatic brain injury case for 287,500. Our client, a 17 year old girl, was struck by a motor vehicle while walking on the side of the curb on Melville Avenue in Fairfield, Connecticut. The defendant claimed our client was at fault for walking in the travel portion of the road. The police cited our client for failure to use a sidewalk. After conducting extensive discovery, we were able to prove by witness account that the police report was wrong and she was not in the travel portion of the road. The accident was caused by the carelessness and negligence of the defendant driver by failing to keep his vehicle under proper and reasonable control. The case settled on the eve of trial.
